In order for us to assist you with an uncontested divorce, you and your spouse must meet the following requirements:

  • At least one of you must have lived in Alabama for the past six (6) months.
  • You must know the location of your spouse and they have agreed to sign all paperwork without requiring service on one party.
  • You and your spouse must have reached an agreement on ALL issues, including child custody/visitation, child support, and property/debt division.

You and your spouse do not have to know all of the specific details of things such as visitation schedules in order for us to assist you, but you need to at least have a broad understanding and agreement on how you both would like to handle such issues going forward.

Once you have contacted us and provided the necessary information, we will then be ready to proceed with the drafting of your divorce paperwork. We typically handle everything via email and telephone so there is no need for you to even come to my office. Once your divorce documents are completed, we will send them to you so you and your spouse can sign them. Once they are signed by you both and notarized where necessary, you will then return them to us for filing. Once the paperwork is filed, Alabama law requires a minimum 30-day waiting period before a divorce is granted. In most cases, neither party will be required to appear in court.

Does your situation not fit the requirements for an uncontested divorce? Don't worry!! We can still assist you even if your divorce will be contested. Contact us for additional information or find additional info here.
